The Commissioner filed his interim report to the Attorney General on February 11, 2009. This report covers the testimony heard at the Inquiry to date. It does not address the issue of Criminal Justice Branch testimony, the status of which is still to be decided.

The Criminal Justice Branch of the Ministry of Attorney General applied for a Judicial Review of the Order of the Commissioner that the Crown Prosecutors involved in the determination as to whether charges should be laid with respect to the death of Frank Paul attend and testify at the Inquiry. The Order of the Commissioner was upheld in the Supreme Court. The Criminal Justice Branch has appealed that decision, with the arguments heard in the BC Court of Appeal in December, 2008. The Court of Appeal ruling, to be released on July 23, 2009, may be viewed at the Court's website: www.courts.gov.bc.ca/court_of_appeal/.

In view of this Court proceeding, the Commissioner’s final report will not be made until a decision on this appeal has been made.

The Government of British Columbia has appointed an independent commission of inquiry to examine the circumstances surrounding the death of Frank Joseph Paul. Mr. Paul, a Mi'kmaq from New Brunswick, was removed from the Vancouver Police Department lockup at about 8:30 p.m. on December 5, 1998, and was left in a nearby alley by a police officer. His body was found in the alley early the next morning. An autopsy concluded he had died from hypothermia due to exposure/alcohol intoxication.

The sole Commissioner, appointed under the Public Inquiry Act, is former B.C. Supreme Court Justice William H. Davies, Q.C.

The commission has been holding hearings since November, 2007 in Vancouver, and has received evidence including testimony from many dozens of witnesses and hundreds of documents. For more information on commission hearings and the work of the commission, please visit the Hearings page.
