Throughout the website, the commission will provide information in blue-grey shaded text boxes to indicate the changes to the website and how it intends to proceed in the completion of its mandate. The Davies Commission of Inquiry will continue with its responsibilities given that the Supreme Court of Canada has not supported the application of the Criminal Justice Branch. Latest NewsThe Supreme Court of Canada announced on 8 April 2010 that it would not hear an appeal sought by the Criminal Justice Branch of the Ministry of Attorney General. See the Commission’s media release for more information. The Commission will be announcing hearing dates with respect to the Criminal Justice Branch as soon as those dates are determined. There will be a procedural hearing (no evidence heard) at 10 a.m. on 8 June 2010 at the Federal Court facility in Vancouver (8th floor, 701 West Georgia Street). Further hearing dates will be published online as soon as they are available. Please check back here for more information. Public Hearings NoticeThe Commissioner will convene public hearings beginning at 10:00 a.m., November 3, 2010. The hearings will be held in Courtroom 601 in the Federal Court facility at 701 West Georgia Street. The hearings with respect to the Criminal Justice Branch are expected to take a few days. Publication of ReportsThe Interim Report for the Frank Paul Inquiry is available. Please visit the Report page to view in PDF format both as a full downloadable file and broken up by section. The Commissioner filed his interim report to the Attorney General on February 11, 2009. This report covers the testimony heard at the Inquiry to date. It does not address the issue of Criminal Justice Branch testimony. The Criminal Justice Branch of the Ministry of Attorney General applied for a Judicial Review of the Order of the Commissioner that the Crown Prosecutors involved in the determination as to whether charges should be laid with respect to the death of Frank Paul attend and testify at the Inquiry. The Order of the Commissioner was upheld in the Supreme Court. The Criminal Justice Branch appealed that decision, but the Court of Appeal for British Columbia denied its appeal. On 8 April 2010, the Supreme Court of Canada declined to grant leave to appeal to the Ministry of Attorney General, bringing to a conclusion the litigation brought by the Criminal Justice Branch of the Ministry of Attorney General. The Government of British Columbia has appointed an independent commission of inquiry to examine the circumstances surrounding the death of Frank Joseph Paul. Mr. Paul, a Mi'kmaq from New Brunswick, was removed from the Vancouver Police Department lockup at about 8:30 p.m. on December 5, 1998, and was left in a nearby alley by a police officer. His body was found in the alley early the next morning. An autopsy concluded he had died from hypothermia due to exposure/alcohol intoxication. The sole Commissioner, appointed under the Public Inquiry Act, is former B.C. Supreme Court Justice William H. Davies, Q.C. The commission held hearings commencing in November, 2007 in Vancouver, and received evidence including testimony from many dozens of witnesses and hundreds of documents.
